"For all that, the allegation of “covert abuse” continues to thrive in the criminal courts. To be sure, Meadow’s “rule” and Munchausen’s Syndrome by Proxy have had to be discarded but the parents of children admitted to hospital with injuries associated with Shaken Baby Syndrome or unexplained fractures are still routinely accused and convicted of having caused them. “The course of injustice has become almost immovable” observes Professor of Law, Deborah Tuerkheimer.
    The arguments have become more nuanced. It may be conceded that in the past parents may have been wrongly convicted and that this pattern of injuries is not necessarily “characteristic” of abuse. But the juggernaut of what has become a remorseless (and for many, very lucrative) child abuse industry rolls on."

In today's Sunday Guardian Global Child Rights and Wrongs series, you hear the voice of children against the Child Protection System - two girls who ran back to their mother after years of forced foster care and a little boy whose cries for his mother went unheeded. Also note the way the child who resists being separated from his family is drugged into submission by the system. A horror story from the heart of the so-called Free World.

This is also yet another story of Western Child Protection Systems (CPS) preying on mothers fleeing domestic violence. The issue of domestic violence victims being targeted by CPS is of particular significance right now as India faces pressure from Western nations to sign the Hague Convention which would enable not just foreign resident parents, but also foreign Child Protection authorities to force children back to the foreign country when they leave with their mothers. All it would take is a report from a CPS authority that the mother is too traumatised to care for the children owing to her experience of domestic violence or some other claim of parental unfitness - however unreasonable. Western child laws and family policies are in a state of crisis right now and we in India should avoid getting into any agreements with Western governments over children.

Very illuminating and thorough article about 'the Hague Convention on the Civil Aspects of International Child Abduction', and the way the United States is trying to make India accept that a child who has once lived in America necessarily is served by staying there or by being brought back there, even if the parent who takes care of it on a daily basis (usually the mother) is back in India.

The point is also made that the Hague Convention is sometimes used not to secure the children living with one if their parents, but to commit children to foster care:

"The prescribed remedy of seeking help from the authorities, thought of in the USA as a safeguard mechanism, is fraught with danger for the children involved. When abuse in a household with children is reported to the authorities, Child Protective Services (CPS) inevitably get involved. The strategy that is generally deployed is to remove the children from the abusive household first and ask questions later. Thus, the mother is not only faced with an abusive marriage, but she also faces losing her children to CPS and ultimately, to foster care."

Compare the way Norway went to court in Poland to make Poland force a girl back to foster care in Norway, Norway trying precisely to have the case run according to the Hague Convention: .

"Readers will get a sense from this of how authoritarian Social Services can be, going to the extent of removing children when their parents disagree with them over their diagnoses or treatment. In the Baby Alfie case the parents’ pleas for alternate treatment fell on deaf ears simply because the public health authorities took a different view to theirs. In Norway too, once Barnevernet make their decision, it is treated as absolute. The thinking seems to be that Barnevernet is never in the wrong, and the parents always are wrong. In the Billö case the Swedish authorities have actually denied the diagnosis of the children’s qualified medical doctor. This family’s case joins a growing number of instances showing the extremes to which public authorities in welfare states of Europe will go to deny parents the opportunity to pursue alternative treatment or go to doctors of their choosing for their children."

"The Trump administration need not have taken the blame entirely on its own shoulders for the separation of children from parents illegally entering its borders. Initially, the controversy did not involve children separated from their parents. It began with an investigation into the whereabouts of some 7,600 children who had come to the US-Mexico border as unaccompanied minors and had been placed with sponsors by the US Department of Health and Human Services (DHHS). It turned out that the DHHS was unable to account for around 1,500 of the children surveyed."

"The basic problem with child protection systems everywhere is that they were conceived of only as a benign state intervention between the supposedly opposing interests of parents and children. Little attention was given to having the usual checks and balances when police or confiscatory powers are given to state agencies."
