"Shame on Norway" was the cry from 500 demonstrators outside the Norwegian embassy in Prague recently. The case of a Czech mother in a Norwegian child protection case has been prominent in Czech media for months, has been taken up in the Czech parliament and led to debate about Norwegian child protection in the Council of Europe and in the European Parliament. So, what is the reaction of the Norwegian government Minister of Children, Solveig Horne: In a reply to district university lecturer Jan Storø in the newspaper Aftenposten, she complains that Norway is misunderstood abroad. But are we misunderstood?

"Norwegian authorities have on several occasions cooperated with foreign media in order to give information about Norwegian child protection. We refute groundless allegations, but the effect of this is limited. It has happened that interviews are crosscut and convey the wrong impression", whimpers Solveig Horne – instead of dealing with a few misunderstandings in the media and a pointed statement from the Czech president, and then actually thinking through whether elements in the criticism might be right.

Is it really taken out of the blue when a nation of culture, one of the most humane nations in Europe, criticises Norway for violations of human rights and brutality against children and their families, when the child protection service (CPS) with poor justification takes children away from their biological parents?

I have followed the debate in the Czech Republic via Czech friends, through acting as advisor for Czech media, and having myself been interviewed about Norwegian child protection several times by Czech tv. The Czechs have been extremely upset at the way a mother does not get her children back, children who were taken from her and their father on the basis of allegations against the father, children who are not returned although the suspicion against the father has been dispelled and the mother has, to be on the absolutely safe side, even divorced him. It particularly offends the Czechs that the sons have been placed in two different families, that the mother is only allowed to see them a couple of times a year, and not least that she is forbidden to speak their mother tongue, Czech, with her own Czech children.

The case has resulted in Czech politicians discovering that Norway is maybe not after all the humanistic, model society they had thought, and has led both politicians and the media to investigate how Norwegian child protection works. The issue has been raised from the single case up to a general level and into a European debate concerning human rights. In this debate Norway stands accused.

I can assure Solveig Horne that the criticism, minus a few peripheral overstatements – and nothing but these overstatements has been taken up by the Norwegian press –, has been exceptionally unbiased and matter-of-fact. There is no need for our Foreign Ministry to explain away anything. What is needed is for Norwegians to understand that the alarm which our system meets with internationally is justified, and the system should be changed. As minister for children, Solveig Horne has this task on her table.

The criticism voiced in the Czech Republic against Norwegian CPS is near identical to the criticism which earlier, all through the 1990s, came from the great humanistic parliamentary politician of Fremskrittspartiet (The Progress Party), John Alvheim. His heart bled for the weak and vulnerable and he fought against injustice. He wanted to strengthen and protect families, instead of tearing them apart by depriving children of their parents just because the CPS – often with incredible arguments – held parents with few resources to "lack in ability to care". In such cases, society should take action with real help, not with destructive "transfers of care". Taking the children away from their parents must be limited to cases in which no real help is possible and where very serious failure to care has taken place.

If Solveig Horne – contrary to what John Alvheim did – chooses to defend the system instead of taking the international criticism seriously and changing the system, then she is the one who fails in care, fails families with few resources, both the parents and their children, who need her helping hand and not her wrath.

Eva Michaláková has been deprived of the 'parental responsibility' for her sons

The Norwegian court and authorities have continued on their destructive path. They have now, as could be predicted, stripped the mother, Eva Michaláková, of her parental rights, which is a move they make to prepare the sons for adoption.

Prague - The Czech Republic will send a protest note to Norway on Wednesday over the decision to strip a Czech mother of her parental rights to her two sons, recently made by Norwegian authorities, Prime Minister Bohuslav Sobotka and other ministers said after their talks today.

    There is a somewhat strange bit of information in the article about the father of the children retaining some rights over the elder boy. The court verdict may contain some reasoning about this, if it is correctly understood.
    But of course it is understandable on the basis that this case is of a favourite type with the child protection people and the whole Norwegian standard view of children and parents and protection: They have succeeded in alienating the parents from each other, leading to divorce, whereupon the CPS 'place confidence' in one party's accusations against the other (here: the father's), even though he was originally the one they accused of misdoings. This is usual: the CPS single out for special condemnation and harsh treatment the parent who is likely the most capable carer of the children.
    In quite a few cases we see the CPS manoeuvring and obtaining a decision which splits the parents (if they are not already at loggerheads) and initially places the children with the parent who is probably the one least capable of taking good care of them. This gives the CPS the opportunity to interfere maximally in the custodian parent's household, coming and going 'like gray cats'. After going on for a year or two in this way, the CPS have then gathered enough ammunition to take the case to the county committee (fylkesnemnda) and the courts again, claiming that 'everything has been tried' but despite all their efforts, the custodian parent has proven incapable of care. And they suggest it is self-evident that the other parent was even worse since he/she had already 'had to be' excluded, so now there is nothing for it but to take the children into foster care.

It seems that the main argument of the court is that the children have been away for so long from their parents now that they have 'got used' to their 'new parents' (the foster people).
    This is a common opinion. It is hardly based on the reality of life as a foster child or an adoptee, but of course the child protection agency uses it for all it is worth: they drag the case out, prevent the mother from keeping contact with her children, and then they make those naïve judges say: "Ah, it's too late!" (Jurists are no end naïve when it comes to child protection and the psychology practiced in that area. They are taught to be, in their studies of law and practice pertaining to child cases.)

Obligation of silence. Again.

The article also says that the mother can freely speak about the case in the media, without risking punishment or revenge from the child protection agency or other Norwegian authorities.

Well-known lies. The child protection agency does not punish the parents. They just protect children, that's all. In their own eyes. A completely obsessive and morbid hypocrisy.

I fear that these children have been saddled with so great damage, damage which inevitably or with all probability stems from the "protection" forced on them by Norwegian child protection.

Will it be too revealing for the involved child protection agents if these children are now set free?

Tis case of the Czech family is also getting known in India. A planned letter to the Norwegian ambassador in India, and another letter to the Czech ambassador in India, have been put out on facebook by Suranya Aiyar, who is greatly concerned with the ways of Western child protection in general and has done a lot of useful work on the issue. We, the undersigned, are following with deep concern the case of the Czech Michalakova boys in Norway who have been snatched from their parents by Child Protection Authorities (Barnevene) in Norway. We understand that the siblings have been separated into different foster homes, their rights to their parents have been permanently terminated and the younger boy has been placed for forced adoption in Norway.

We are shocked to see the Norwegian authorities taking such brutal steps when the boys have grandparents and aunts in the Czech Republic who have been appealing to the Norwegian authorities to be given the boys. This is a gross denial of the boys’ right to their family and to being raised in the culture of their origins.

We have had similar experiences of children of Indian parents in Norway being snatched by Barneverne which refuses to release such children for repatriation to their extended family in India. In the cases where efforts against the Norwegian authorities to reunite families have been successful, the children are thriving, happy and well-settled in India.

There indeed appears to be a severe humanitarian crisis in countries like Norway with despotic and, often racist, Child Protection Authorities snatching children from parents on spurious grounds and denying them a relationship even with extended family members.

We would like to express our appreciation and support for the Czech Government’s robust humanitarian intervention in the Michalakova case. We wish you success in this laudable and child-friendly endeavour. We express our sympathies to the brave mother of the boys, Eva Michalakova, in her battle to regain custody of her children.

FACTS OF THE MICHALAKOVA CASE

The Michalakovas were a Czech family living in Norway with two boys. In May 2011, Norwegian Child Protection Authorities (Barneverne), started abuse proceedings against the father claiming that he had sexually abused the elder boy. The proceeding were initiated upon on a statement the boy had allegedly made in kindergarten that his father had “fumbled with his hand over the pyjamas”.

The children, then aged about 5 and 2 years, were sent for an assessment to a local hospital which did not confirm any abuse and the police dropped the case due to lack of evidence.

Despite this, Barneverne continued the case and in February 2012, the boys were placed in separate foster homes with the children being permitted to see their mother only twice a year. During visitations she was under Barneverne surveillance and instructed not to embrace her sons or speak to them in the Czech language.

Barneverne allegedly told the mother that the children would be returned to her if she divorced their father. But even though she divorced the father, the boys were not returned and she now found herself to be at the receiving end of investigations by the Barneverne for parental incompetence. There were allegations that she had smacked her elder boy on the bottom.

With the prospects of the mother winning the case for custody of the children before Norwegian authorities looking weak, the boys’ grandparents and aunt from the Czech Republic applied for permission to take over custody of the boys, but were refused.

The children’s mother appealed to the Czech Government for help, which took up the case at the highest level. The Czech President wrote in protest to the Norwegian King, the Czech Foreign Minister issued a series of protest notes to the Norwegian Ambassador and various members of the European Parliament have protested about the case. There were public demonstrations in the Czech Republic against the Norwegian actions.

However, the Norwegian authorities only hardened their position with the publicity given by the Czechs to the case and in the last few days orders were issued permanently terminating the mother’s parental rights and placing the younger boy (now 6 years old) in a Norwergian adoptive family. Barneverne officials have reportedly said that these actions were owing to the mother’s going to the press about the case and not releasing the boys’ passports to the Norwegian authorities.

In response, the Czech President has cancelled his invitation to the Norwegian Ambassador to attend the celebrations for a major national event, the anniversary celebrations for the independence of Czechoslovakia in 1918.

Ironically, though the entire case started with sexual abuse allegations against the father, he has been allowed to retain some parental rights over the elder boy, and the main target of Barneverne has become the mother. Listed below are links some reports on the case:

A cross-section of concerned Indians, including academics, writers, corporate executives, child rights workers and homemakers, have written to the Czech Ambassador in New Delhi expressing “appreciation and support” for the Czech Republic’s firm stand against Norway in a foster case involving two young boys of Czech origin.

Despite diplomatic intervention at the highest level, the Norwegian authorities refused to release the boys, even to their Czech grandparents and aunts and gave the younger boy away in adoption in Norway.

In response, the Czech President has cancelled his invitation to Norway for the anniversary celebrations at the Presidential Palace in Prague for the 1918 independence of Czechoslovakia, which is a major national event.

Praising the intervention of the Czech Republic as “humanitarian and child-friendly”, the signatories to letter, which was handed over in New Delhi today to the Czech Embassy, say that they “are shocked to see the Norwegian authorities taking such brutal steps when the boys have grandparents and aunts in the Czech Republic...…. We have had similar experiences of children of Indian parents in Norway being snatched by Barnevernet which refuses to release such children for repatriation to their extended family in India. There indeed appears to be a severe humanitarian crisis in countries like Norway with despotic and, often racist, Child Protection Authorities snatching children from parents on spurious grounds and denying them a relationship even with extended family members.”

The boys in the Czech case were removed by Barnevernet in 2011, then aged about 5 and 2 years, on suspicion of sexual abuse by the father. Barnevernet refused to release the boys even though the suspicion was not proven, and the police dropped the case. Though the entire case started with sexual abuse allegations against the father, he has been allowed to retain some parental rights over the elder boy (who remains in foster care), while the parental rights of the mother, Eva Michalakova, have been terminated. After the case against the father failed, the Barnevernet had turned its sights on the mother.

The signatories have also written to the Norwegian Ambassador in New Delhi expressing their “deep concern” in this case, saying that “Barnevernet can act harshly and unjustly”. Referring to the case of the Bhattacharya children who were taken into foster care in Norway, resulting in a major diplomatic row between Norway and India a few years ago, the letter says “We are happy to inform you that the children returned to India in the Bhattacharya case are thriving with their mother and grandparents here.”

Excellency,

This is to bring to your kind attention our deep concern regarding the plight of the Czech Michalakova boys confiscated by Barnevernet in Norway. In previous cases the Norwegian Government has observed that Barnevernet can act harshly and unjustly. We are happy to inform you that the children returned to India in the Bhattacharya case are thriving with their mother and grandparents here.

We are hopeful, that despite the many differences between nations, as human beings, we can all feel the same concern that two innocent boys with willing family members in the Czech Republic to take over their care should not be orphaned in Norway.

We have submitted a statement in support of the interventions of the Czech Government in this matter, a copy of which is enclosed for your kind consideration.

PRESS RELEASE 2 November 2015

Protesting against visiting Norwegian Foreign Minister Borge Brende, an activist, Suranya Aiyar, is driving around Delhi with the slogan “Norway Steals Children!” “Boycott Norway!”. Attached are photos [on facebook].

Under Norwegian laws child protection authorities can permanently remove children from parents, even of foreign nationals on holiday or short term work assignments there.

Aiyar, who has been campaigning against this form of child protection for some years, says that children are removed on frivolous and, often, racist grounds from innocent parents. Of particular concern to her and her supporters is the refusal of Norway to return such children even to extended family in their home countries.

In a case that occurred a few years ago with a Bengali family in Norway, the children were returned only after high level intervention by the Indian [authorities] and recently in a similar case of a Czech family, the Norwegian authorities have, so far, refused to repatriate such children to their extended family in Czechia and instead placed them for forced adoption to Norwegians. Norway has come under criticism from several countries for unjustifiably removing children from their parents.
