James Le Fanu:
Theories and frameworks misdefining child abuse –
(Part 1)
Instances of physical and mental abuse of children can be traced back to antiquity, but it was only recently that a flawed legal framework added to the complexity of this issue, leading to wrongful convictions.
Sunday Guardian, 10 March 2018

James Le Fanu is a British physician and writer. He was educated at Cambridge University and the Royal London Hospital. His articles have appeared in medical journals such as the British Medical Journal. He writes as a medical journalist in the well-known British newspapers: the Daily Telegraph and the Sunday Telegraph.

James Le Fanu:
Guilty until proved innocent is the new legal standard
(Part 2)
Sunday Guardian, 18 March 2018

"For all that, the allegation of “covert abuse” continues to thrive in the criminal courts. To be sure, Meadow’s “rule” and Munchausen’s Syndrome by Proxy have had to be discarded but the parents of children admitted to hospital with injuries associated with Shaken Baby Syndrome or unexplained fractures are still routinely accused and convicted of having caused them. “The course of injustice has become almost immovable” observes Professor of Law, Deborah Tuerkheimer.
The arguments have become more nuanced. It may be conceded that in the past parents may have been wrongly convicted and that this pattern of injuries is not necessarily “characteristic” of abuse. But the juggernaut of what has become a remorseless (and for many, very lucrative) child abuse industry rolls on."

Mrutyuanjai Mishra:
A single mother who lost her children in Denmark
Sunday Guardian, 5 May 2018

In today's Sunday Guardian Global Child Rights and Wrongs series, you hear the voice of children against the Child Protection System - two girls who ran back to their mother after years of forced foster care and a little boy whose cries for his mother went unheeded. Also note the way the child who resists being separated from his family is drugged into submission by the system. A horror story from the heart of the so-called Free World.

This is also yet another story of Western Child Protection Systems (CPS) preying on mothers fleeing domestic violence. The issue of domestic violence victims being targeted by CPS is of particular significance right now as India faces pressure from Western nations to sign the Hague Convention which would enable not just foreign resident parents, but also foreign Child Protection authorities to force children back to the foreign country when they leave with their mothers. All it would take is a report from a CPS authority that the mother is too traumatised to care for the children owing to her experience of domestic violence or some other claim of parental unfitness - however unreasonable. Western child laws and family policies are in a state of crisis right now and we in India should avoid getting into any agreements with Western governments over children.

Jan Simonsen and Marianne Haslev Skånland:
A case exposing the double standards of Norway's CPS
Sunday Guardian, 12 May 2018

Sunday Guardian's introduction:
One of Norway’s top child-protection policy experts, **** (Name censored due to Norwegian authorities. -admin), was sentenced to prison under the country’s child pornography laws. His arrest further discredits Norway’s Child Protection Services.

*

"A child psychiatrist and top child protection expert, 56-year-old **** (Name censored due to Norwegian authorities. -admin), who in 2010 became the single father to two Indian surrogate babies, has been sentenced to nearly two years’ jail under Norway’s child pornography laws.
**** (Name censored due to Norwegian authorities. -admin) was found guilty of possessing and sharing an enormous quantity of material—about 200,000 pictures and 4,000 hours of video—showing children subjected to brutal sexual abuse. The indictment against **** (Name censored due to Norwegian authorities. -admin) reads: 'Pictures and videos show sexual abuse committed by adults against children, sexual acts between children, and children performing sexual acts on themselves.'
This case is symptomatic of the Norwegian child protection services (CPS) system (known as 'Barnevernet') and our authorities’ attitude to it. It demonstrates the double standards of what people in authority do and say in relation to the strict legislation regarding children that they themselves promote and through which they exercise power."

"In connection with the court case against **** (Name censored due to Norwegian authorities. -admin) this year, once again an expert has been appointed to assess the possible consequences to his own two children. .......
....
So this publicly appointed psychological expert’s evaluation of the situation of his/her fellow expert’s children is that the father is trustworthy, not likely to be any danger to them although they will shortly be of an age which has been the preferred age group for his picture and video searches, and that it is the penal system and the CPS which will be harmful to them? These observations are interesting, since the army of psychological professionals employed by the CPS normally hold the interference of the CPS and themselves into families to be a trivial burden, or no burden at all, on children and parents alike 'if the care is found on investigation to be good'. Likewise, they normally hold the removal of children from their parents’ care to be utterly good for the children if the psychological experts and the social workers 'think' so."

"Unfortunately so far there is no sign of any question from the sections of government in charge—the Ministry of Children and Equality, the Ministry of Health and Care Services or the CEC—regarding whether this case has a bearing on the general way the CPS is regulated and run, or regarding the reliability and scientific basis of the work of the CEC."

Niharika Dass:
India must not give in to the US’ ‘global bullying’ tactics
Sunday Guardian, 19 May 2018

Very illuminating and thorough article about 'the Hague Convention on the Civil Aspects of International Child Abduction', and the way the United States is trying to make India accept that a child who has once lived in America necessarily is served by staying there or by being brought back there, even if the parent who takes care of it on a daily basis (usually the mother) is back in India.

The point is also made that the Hague Convention is sometimes used not to secure the children living with one if their parents, but to commit children to foster care:

"The prescribed remedy of seeking help from the authorities, thought of in the USA as a safeguard mechanism, is fraught with danger for the children involved. When abuse in a household with children is reported to the authorities, Child Protective Services (CPS) inevitably get involved. The strategy that is generally deployed is to remove the children from the abusive household first and ask questions later. Thus, the mother is not only faced with an abusive marriage, but she also faces losing her children to CPS and ultimately, to foster care."

Compare the way Norway went to court in Poland to make Poland force a girl back to foster care in Norway, Norway trying precisely to have the case run according to the Hague Convention: Judgment in Poland: a nine-year-old girl NOT to be extradited to Norway.

The article is now also on SaveYourChildren:
Indian mothers stand up to US bullying in the name of “child welfare”

Lars-Toralf Storstrand:
Authoritarian childcare in Europe’s liberal democracies
Sunday Guardian, 26 May 2018

"Readers will get a sense from this of how authoritarian Social Services can be, going to the extent of removing children when their parents disagree with them over their diagnoses or treatment. In the Baby Alfie case the parents’ pleas for alternate treatment fell on deaf ears simply because the public health authorities took a different view to theirs. In Norway too, once Barnevernet make their decision, it is treated as absolute. The thinking seems to be that Barnevernet is never in the wrong, and the parents always are wrong. In the Billö case the Swedish authorities have actually denied the diagnosis of the children’s qualified medical doctor. This family’s case joins a growing number of instances showing the extremes to which public authorities in welfare states of Europe will go to deny parents the opportunity to pursue alternative treatment or go to doctors of their choosing for their children."
